That the Chief Justice of India, Dipak Mishra was guilty of selectively assigning important cases to junior hand picked judges, was the most crucial accusation against him by the 4 senior-most colleagues. Is this really true?
Representation of Collegium lowest since 1999
Well, a special study by “The Hindu,”published on 26.8.2018 reveals the actual figures and they prove that the CJI’s role as the Master of the Roster was culpable. The Collegium members(ranked 2 to 5) delivered only 29.3% of the judgements in major cases(benches of 3 or more) till January this year, when they shocked the nation by publicly complaining about the matter to the press.
After the unprecedented press conference by Justices J. Chelameswar, Ranjan Gogoi, Madan B. Lokur and Kurian Joseph, their representation and judgement in major cases only marginally increased to 33.9%. These figures reveal their plight and confirm that this was the lowest among 17 CJI’s since 1999.
Another fact that comes out in this study is that the average representation for Collegium judges(barring the CJI) from 1999 till the present CJI was 52.1%
